General Terms and Conditions of Business for OSD Congresses

General Terms and Conditions of Business for OSD Congresses

1. Registration & Conclusion of Contract

Interested persons can register for the Congress online using the Cvent event management system. By registering, participants acknowledge the following contractual conditions. Registration is legally effective once the registration process is complete, payment has been received, and OSD has provided written confirmation.

Spaces are limited and will be assigned based on the date of registration and payment of the congress fees.

2. Congress Fees & Payment

The congress fee amount, the terms of payment, and bank account details are provided on the internet. Unless otherwise shown in the confirmation of registration, these are due in full immediately after registration.

After registration has been completed successfully, the participant will receive an invoice for the congress fee amount.

3. Right of Cancellation and Termination

If a participant is entitled to cancel the contract as per No. 4 of these General Terms and Conditions of Business, the following provisions on cancellation and termination of the participant will apply only if the contract is not cancelled during the cancellation notice period regulated there.

Cancellations will be accepted by OSD only through the Cvent event management system or in writing.

For cancellations up to four weeks before the congress starts, the entire congress fee will be reimbursed less a processing charge of € 50. For later cancellation or absence, the entire congress fee will be retained.

The effective date for cancellation and withdrawal by participants is the date cancellation is received in the Cvent system or the date written declaration is received by OSD.

Participants who want to cancel may designate a substitute to attend in their stead. In this case there are no additional costs.

The OSD may also cancel the contract without notice for an important reason such as continued disruption to courses, breaches by participants of copyright (No. 8.) or violation of the house rules. This will not give the participant a right to reimbursement. The OSD reserves the right to assert further damages claims.

4. Instructions for Consumers on Cancellation Rights

The following instruction on cancellation applies only to consumers further to Section 13 of the German Civil Code and therefore does not apply to contracts with the OSD concluded by merchants further to Section 14 of the German Civil Code as part of their commercial or self-employed professional activities.

5. Cancellations by OSD & Organisational Changes to Congresses

The OSD is entitled to cancel courses in cases of Acts of God or insufficient registrations (four weeks before courses start). In this case, participants will be informed without undue delay and the OSD will reimburse in full the congress fees already paid. Participants will not be entitled to any further reimbursements; in particular, they will not be entitled to reimbursement of travel or accommodation costs or for loss of time at work.

The OSD also reserves the right to make organisational changes. These include changes in lecturers and change of location within a reasonable distance from the original course location. The OSD will try to announce organisational changes in good time.
However, should individual sessions have to be cancelled unexpectedly, the participant will not be able to assert any rights.

6. Certificate of Participation

Participants will receive a certificate of participation based on the training sessions attended at the congress.

7. Exclusion of Liability

OSD accepts no liability for personal injury, property damage or financial losses occurring during each congress.

OSD expressly points out that congress content, teaching content, and lecture and book material constitute recommendations only. The choice of each form of therapy/medication/treatment is in all cases a decision that the participant/therapist must make him/herself after due consideration of each situation. No claims may be asserted against the lecturers or the OSD for any consequences of using such forms of therapy/medication/treatment. Participation in all congresses is voluntary and at each participant’s personal responsibility.

Otherwise, OSD will only be liable for damage caused intentionally or through gross negligence on the part of OSD.

8. Copyright

For copyright reasons, no video recording, filming, photography or audio recording is permitted during lectures and workshops.

All teaching and instructional materials are given to participants for their sole and non-transferrable personal use. The materials issued may be neither duplicated nor used for commercial and/or freelance purposes. Where copyright is breached, the OSD reserves the right to assert damages claims.

Please note that filming and photography will take place during the congress. It is therefore an unavoidable possibility that you may appear along with other people in a recorded image. We have also made provisions for such recorded images to be made of individuals. Please let the photographer know in advance if you prefer not to be photographed or filmed as an individual.

9. Data Protection Notice

OSD stores the personal data from all participants electronically in order to administer existing contracts with participants. This data is only disclosed to third parties if you explicitly consent to such disclosure during the registration process.

10. Ancillary Agreements

Ancillary agreements must be in writing.

11. Legal Venue

The sole legal venue and place of fulfilment for all legal disputes arising from this contractual relationship is Hamburg if a participant is a merchant, legal entity in public law or a special fund in public law. This agreement on a legal venue will also apply if a participant has no general legal venue in Germany.

12. Ineffective Clauses

If an individual clause in these conditions is ineffective, this shall not affect questions of whether the remaining clauses are effective.
