General Terms and Conditions of Business for Advanced Vocational Courses

1. Registration & Conclusion of Contract

Interested persons can register for all advanced vocational courses in writing using the registration form (by post, email or fax), online or personally at the OSD in Hamburg. By registering, participants acknowledge the following contractual conditions. Registration is legally effective only on payment of the course fees referred to in the registration form and on receipt of written confirmation by the OSD.

Due to the limited number of places in our courses, we accept registrations in order of receipt and receipt of payment to the OSD bank account.

2. Course Fees & Payment

The amounts of the course fees and bank account details are on the registration forms and in the internet. Unless otherwise shown in the confirmation of registration, these are due in full immediately after registration.

If a participant registers for three of more courses simultaneously, instalment payments may be agreed on written application.

3. Right of Cancellation and Termination

If a participant is entitled to cancel the contract as per No. 4 of these General Terms and Conditions of Business, the following provisions on cancellation and termination of the participant will apply only if the contract is not cancelled during the cancellation notice period regulated there.

Cancellations will be accepted by the OSD in writing only.

For cancellations up to four weeks before the course starts, the entire course fee will be reimbursed less a processing charge of € 50. For later cancellation or absence, the entire course fee will be retained.

The effective date for cancellation and withdrawal by participants will be the date such written declarations are received by the OSD.

Participants who want to cancel may propose a substitute who is verifiably eligible for the course. In this case there are no additional costs.

The OSD may also cancel the contract without notice for an important reason such as continued disruption to courses, breaches by participants of copyright (No. 8.) or violation of the house rules. This will not give the participant a right to reimbursement. The OSD reserves the right to assert further damages claims.

4. Instructions for Consumers on Cancellation Rights

The following instruction on cancellation applies only to consumers further to Section 13 of the German Civil Code and therefore does not apply to contracts with the OSD concluded by merchants further to Section 14 of the German Civil Code as part of their commercial or self-employed professional activities.

Instructions on Consumer Cancellation Rights

You are entitled to cancel this contract within 14 days without giving reasons.

The cancellation period is 14 days from the date the contract is concluded.

To exercise your right of cancellation, you must inform us of your decision to cancel this contract in an unambiguous declaration, e.g. by post, fax or email to:

You may use the attached sample consumer cancellation form; however, this is not prescribed by law.

To comply with the cancellation deadline, it suffices to send your notice about exercising your right of cancellation during the cancellation period.


Consequences of Cancellation

If you cancel this contract, we will be obliged to reimburse all payments we have received from you, including delivery costs (except additional costs incurred if you chose a kind of delivery other than the cheapest standard delivery offered by us), without undue delay and no later than 14 days from the date we received your declaration of the cancellation of this contract. We will use the same means of payment that you used in the original transaction unless other arrangements have been expressly made. In no case will you be charged anything for this reimbursement.

If you demanded that services/courses begin during the cancellation period, you will be required to pay us an appropriate amount corresponding to those services performed/courses taken up to that date on which you informed us that you were exercising your right to cancel this contract in comparison to the total number of services/courses provided for in the contract.

5. Cancellations by OSD & Organisational Changes to Advanced Vocational Courses

The OSD is entitled to cancel courses in cases of Acts of God or insufficient registrations (four weeks before courses start). In this case, participants will be informed without undue delay and the OSD will reimburse in full the course fees already paid. Participants will not be entitled to any further reimbursements; in particular, they will not be entitled to reimbursement of travel or accommodation costs or for loss of time at work.

The OSD also reserves the right to make organisational changes. These include changes in lecturers and change of location within a reasonable distance from the original course location. The OSD will try to announce organisational changes in good time. However, should an individual lesson have to be cancelled, the participant will not be able to assert any rights.

6. Certificate of Participation & Confirmation of Payment

Each participant will receive a certificate of participation & confirmation of payment

7. Exclusion of Liability

The OSD accepts no liability for death, physical injury, property damage or loss of profits occurring during each course.

The OSD expressly points out that course and teaching content, script and book material only constitute recommendations. The choice of each form of therapy/medication/treatment is in all cases a decision that the participant/therapist must make him/herself after due consideration of each situation. No claims may be asserted against the lecturers or the OSD for any consequences of using such forms of therapy/medication/treatment. Participation in all courses is voluntary and at each participant’s personal responsibility.

Otherwise, the OSD will only be liable for damage caused intentionally or out of gross negligence.

8. Copyright

All teaching and instructional materials are given to participants for their sole and non-transferrable personal use. The materials issued may be neither duplicated nor used for commercial and/or freelance purposes. Where copyright is breached, the OSD reserves the right to assert damages claims.

The OSD allows video and sound recordings and photographs of the practical course contents to be taken, insofar as the lecturer permits. In return, participants consent to the OSD and other participants making audio and video recordings. Use of these recordings for a fee or as part of activities for a fee by the OSD is prohibited.

Personally-made recordings and course materials may be used only for advanced or initial vocational training of participants of the course in question. Giving third parties any materials referred to, whether wholly or in part or for a fee or free of charge, is expressly prohibited unless these parties are participants in the relevant course. Duplicating the materials referred to or interfering with the protected copyright of others is also expressly prohibited.

9. Data Protection

The OSD stores its person-related data of all participants electronically in order to administer existing contracts with participants. None of this data is passed to third parties.

10. Ancillary Agreements

Ancillary agreements must be in writing.

11. Legal Venue

The sole legal venue and place of fulfilment for all legal disputes arising from this contractual relationship is Hamburg if a participant is a merchant, legal entity in public law or a special fund in public law. This agreement on a legal venue will also apply if a participant has no general legal venue in Germany.

12. Ineffective clauses 

If an individual clause in these conditions is ineffective, this shall not affect questions of whether the remaining clauses are effective.
